What Is a Brake Fade Accident and Why Does It Happen?

Brake Fade Can Leave A Truck With Brakes That No Longer Stop It Effectively

A tractor-trailer doesn't need a broken brake line or a completely failed braking system to cause a serious truck accident. Sometimes the brakes are still functioning, but they have become so hot that they can no longer slow the truck as effectively as they should. That dangerous loss of braking power is known as brake fade.

Brake fade can develop gradually as a driver repeatedly applies the brakes, particularly when descending a long grade or controlling a heavily loaded truck. The first few brake applications may feel normal. As heat builds, though, the truck can require more distance to slow down. By the time the driver realizes how much stopping power has been lost, traffic ahead may already be too close.

Brake Fade Is Caused By Heat, Not Necessarily A Broken Part

Every time a truck's brakes are applied, friction helps convert the vehicle's motion into heat. Commercial braking systems are designed to handle substantial heat, but there are limits to how effectively that heat can be managed.

When the brakes are used repeatedly or continuously, temperatures can climb high enough to reduce braking effectiveness. With drum brakes, heat can cause the brake drum to expand away from the brake shoes, reducing the braking force produced. Disc brakes are generally less susceptible to this type of fade, although excessive heat can still affect braking performance.

The Federal Motor Carrier Safety Administration cites testing that demonstrates just how dramatic the difference can become. In tractor-trailer testing at 60 mph, the stopping distance for drum brakes increased from approximately 270 feet to 450 feet after 15 repeated stops. Air disc brake stopping distance remained close to 200 feet.

That means a brake-fade accident can happen even though the driver presses the brake pedal and the braking system responds. The problem is that the truck isn't slowing nearly as effectively as it did before the brakes overheated.

Long Downhill Grades Create One Of The Biggest Brake Fade Risks

Brake fade becomes particularly dangerous on long descents because gravity is constantly working to accelerate the truck while the driver is trying to control its speed.

Commercial drivers are trained to enter a downgrade at a safe speed, select an appropriate gear, and avoid relying continuously on the service brakes to hold the truck back. FMCSA advises drivers to use the proper gear and available retarding systems while applying the service brakes sparingly on long grades.

Consider a loaded tractor-trailer approaching a steep downgrade. The driver enters the hill too fast and remains in a gear that doesn't provide enough engine braking. Instead of slowing before the descent, the driver keeps pressure on the service brakes almost continuously.

At first, the truck stays under control. Several miles later, the brakes have absorbed enormous amounts of heat. Traffic backs up near the bottom of the grade, the driver applies the brakes harder, and the truck doesn't slow the way it did at the top of the hill. That is a classic brake-fade scenario.

The driver didn't necessarily experience a sudden mechanical failure. The dangerous situation developed through a combination of speed, braking technique, road grade, vehicle weight, and heat.

Worn Or Poorly Maintained Brakes Can Make Fade Even More Dangerous

Driver technique isn't the only issue investigators should examine.

Federal regulations require commercial vehicle brake components to be constructed, installed, and maintained in a way that prevents excessive fading and provides safe, reliable stopping. 49 C.F.R. § 393.47 also establishes requirements for brake linings, pads, drums, rotors, brake chambers, and adjustment limits.

Problems involving commercial truck brake maintenance can reduce the safety margin a driver has before overheating becomes critical. Investigators may find:

  • Worn brake linings or pads
  • Brakes that are improperly adjusted
  • Damaged drums or rotors
  • Brakes on some wheel positions that aren't contributing properly
  • Prior brake complaints that weren't adequately addressed
  • Inspection records showing delayed or incomplete maintenance

A truck with several poorly performing brakes may force the remaining brakes to handle more of the work. When that happens on a long descent or during repeated hard stops, heat can become an even bigger concern.

Brake Fade And Brake Failure Aren't The Same Thing

This distinction can matter enormously after a crash.

A mechanical brake failure may involve a broken component, an air leak, a damaged brake chamber, a defective part, or another condition that prevents the braking system from functioning properly.

Brake fade is different. The brake components may still move and operate, but excessive heat has reduced the amount of stopping force they can produce.

That means investigators shouldn't automatically conclude that the brakes played no role simply because a post-crash inspection shows that the system is capable of operating. The more important question can be how the brakes were performing during the minutes immediately before impact.

A Brake Fade Investigation Has To Reconstruct What Happened Before Impact

The police report usually can't answer whether a truck's brakes faded. By the time the wreck has been cleared and the truck is inspected, investigators need to reconstruct the conditions that existed before the collision.

Important evidence may include:

  • Electronic Control Module Data: Truck data may help establish speed, braking activity, throttle use, and changes in speed before impact.
  • Road Grade and Route: Investigators can determine whether the truck had just traveled down a long or steep grade where repeated braking would have generated significant heat.
  • Brake Inspection: A qualified expert can examine the condition and adjustment of the brakes, linings, pads, drums, rotors, and other components.
  • Maintenance Records: Prior inspections and repair records may show recurring brake problems or maintenance that wasn't completed when it should have been.
  • Driver Training: Records may show whether the driver had been properly trained to manage speed and braking on steep grades.
  • Dispatch and Route Information: The truck's route can help establish where it traveled and what terrain the driver encountered before the crash.

Federal rules require motor carriers to systematically inspect, repair, and maintain commercial vehicles under their control. Those maintenance records can become critical when a trucking company argues that a crash was an unavoidable equipment problem rather than the result of preventable safety failures.

The Driver And Trucking Company May Both Face Questions

A brake-fade case shouldn't automatically be blamed entirely on either the driver or the maintenance department. Sometimes the evidence points to failures on several levels.

The driver may have descended a grade too quickly, ridden the brakes, ignored warning signs, or failed to inspect the vehicle properly. The trucking company may have failed to maintain the brakes, repair a known problem, train the driver for mountain driving, or take a vehicle out of service when repairs were necessary.

Under 49 C.F.R. § 396.3, motor carriers must systematically inspect, repair, and maintain vehicles under their control and keep safety-related parts in proper operating condition. Drivers also have a responsibility to be satisfied that the vehicle is in safe operating condition before driving.

Depending on what caused the braking problem, responsibility may also extend to a maintenance contractor or equipment manufacturer. That's why identifying the actual cause matters before deciding who should be held accountable.

Brake Fade Can Turn Into A Rear-End, Jackknife, Or Runaway Truck Crash

Once a truck loses effective braking power, the driver may have only bad options left.

If traffic is stopped ahead, brake fade can result in a devastating rear-end truck collision. If the driver brakes aggressively after realizing the truck isn't slowing properly, differences in traction and braking force can contribute to instability and a jackknife crash.

On a steep downgrade, a truck may continue gaining speed until the driver can no longer control it. That can lead to a collision with vehicles ahead, a rollover, a departure from the roadway, or an attempt to use a runaway-truck ramp where one is available.

These crashes can look very different at the scene, but the same underlying question remains: why couldn't the truck slow down when the driver needed it to?
